Overview
اعتمد المشرع الجزائري على مجموعة من الآليات القانونية بغية تطهير شامل للوضعية العقارية، فتبني نظام الشهر العيني، ومن أجل تطبقه عمل على صياغة نظام المسح الأراضي الذي يتكفل بوصف الحالة المادية والقانونية للعقار من أجل إعطاء أرضية قانونية صلبة للملكية العقارية ولباقي الحقوق العينية المترتبة عنها، على اعتبار أن عملية مسح الأراضي وما يرافقها من إجراءات متمثلة في تحديد حدود البلديات، والملكيات داخل كل بلدية، وإجراء التحقيق العقاري في الميدان لإبراز الملاك وأصحاب الحقوق وإعداد وثائق المسح من مخططات وسجلات مع تسجل جميع الاعتراضات المقدمة من طرف الملاكين وطرحها على اللجنة البلدية لمسح الأراضي لدراستها والبت فيها، وبذلك تنتهي عملية مسح الأراضي إلى إنشاء السجل العقاري الأمر الذي يطهر بصفة نهائية الملكية العقارية.
