Overview
يمثل الاجتهاد بالرأي في النصوص، سبيلا للإيفاء بحاجات الناس، والإجابة عما يعترضهم من أحوال ووقائع ومستجدات، من خلال إعمال النصوص واستثمار جميع مكنوناتها وطاقاتها ودلالتها واستجلاء روح التشريع، وقد تناولت هذه الدراسة حقيقة الاجتهاد بالرأي في النصوص، وكيفية توظيفه في عملية استنباط الأحكام الشرعية في المسائل المعاصرة ومنها ما نحن بصدده: الحسابات الفلكية في إثبات الأهلة، وأكدت الدراسة أن الاجتهاد بالرأي في النصوص القطعية يكون في التطبيق والتنزيل والفهم، وأن الأخذ بالمذهب القائل بالأخذ بالحسابات الفلكية في إثبات الأهلة فيه دلالة على مرونة الفقه الإسلامي ومقدرته على مواكبة تطورات العصور والأزمان.
