تناول البحث مدى تأثير الحقوق المكتسبة في القانون الإداري على النفاذ الرجعي للقرارات الإدارية، واتضح من خلاله على الإدارة ان تسعى الى تحقيق التوازن بين مبدأ يالمشروعية والأمن القانوني عند تزاحمهما حماية للحقوق المكتسبة من جهة، ومراعاة توافق تصرفاتها مع القانون من جهة أخرى في ضوء المبادئ التي اقرها الاجتهاد الإداري.
