يتضمن هذا المقال التنظيم القانوني والتشريعي لاتفاقيات الشغل الجماعية مدى أهميتها في خلق توازن بين مصالح الأجراء المتمثلة في اشتغالهم في ظروف عمل مناسبة وأخذ حقوقهم وبين ضمان مصلحة المشغل المتمثلة في استمرارية نشاط المقاولة، وأهمية هذه الاتفاقيات الجماعية في إثبات الالتزامات أمام المحاكم. وذلك من أجل تحقيق السلم والأمن الاجتماعيين داخل المقاولة وضمان مشاركة الأجراء في صنع القرار داخل هذه المقولة من خلال النقابات المهنية ونقابات الأجراء.
