بعد التحول لاقتصاد السوق أبان المشرع الجزائري عن هدفه في تحسين مناخ الأعمال وتشجيع ازدهار المؤسسات خاصة مع بروز مؤشرات قوية على قيام أزمة اقتصادية جديدة، ولتجسيد ذلك بادر بإدخال إصلاحات نوعية مست المبدأ الأساسي المعتبر عنه بمبدأ حرية الاستثمار والتجارة، لتوسيع مجال نفاذ الاستثمارات الخاصة في الأنشطة الاقتصادية المختلفة، غير أن هذا التوسع رافقه تكريس لقيد عام يحد من مجال تدخل الأشخاص في أنشطة معينة وهو ما يؤثر سلبا على التنمية الاقتصادية الوطنية خاصة وأن المستثمرين الخواص يفضلون الاستثمار في الأسواق يتمتعون فيها بحرية المنافسة.
