Overview
إن المشرع يولي عناية بإجراءات التنفيذ إلا أنه رغم ذلك يوجد من يدعو نحو التخفيف من تعقيد إجراءات التنفيذ العقاري، ذلك أن بطئ إجراءات التنفيذ على العقار تؤدى إلى ضعف الائتمان العقاري مما لا يشجع عملية الاقتراض العقاري، لذلك يسعى المشرع إلى ضع إجراءات للتوفيق بين مصلحة الدائن المرتهن (بنك أو مؤسسة مالية) في التنفيذ السريع لاقتضاء حقه، ومصلحة المدين الراهن أو الكفيل العيني في حمايته من تعسف الدائن عند التنفيذ من جهة، ومن جهة أخرى نظرا لأهمية العقار الاجتماعية وقيمته الاقتصادية فان الحجز على العقار يخضع لإجراءات وتدابير خاصة.
