Overview
تنطلق هذه الدراسة من هدفين رئيسين هما التعرف على طريقة تسجيل وثيقة إشهاد شرعي على أربعة تصرفات في مجلس عقد واحد، هذه التصرفات هي رهن أرض ملك حسين باشا فاضل يكن وأخيه إبراهيم توفيق باشا، وحوالة دين، ورهن أرض ملك حسين باشا فاضل، وتفاسخ عقد رهن سابق للأرض المرهونة نفسها للراهنين، وتحقيق هذا الهدف يتطلب إقامة النص، وتحليل الخصائص الداخلية والخارجية لتلك الوثيقة؛ والتعرف على مدى التشابه والاختلاف بين أجزاء وصيغ الوثيقة وبين الأجزاء والصيغ التي وضعها الشرطيون والموثقون، وهذا يتطلب المقارنة بين نص الوثيقة والقواعد التي وضعها الشرطيون والموثقين، والهدف الثاني استنباط قواعد كتابة أكثر من تصرف في ورقة واحدة، وقد استخدم البحث لتحقيق هذه الأهداف المنهج التاريخي، ومنهج دراسة الحالة.
