Overview
إن نية المشرع في إقرار وتجسيد ازدواجية إجرائية تتماشى والازدواجية القانونية والهيكلية، أمر فرضته مجرد توزيع قواعد الاختصاص النوعي بين جهة القضاء العادي من جهة، وبين جهات القضاء الإداري ذاتها، والتي تبنى أساساً على فكرة المعيار العضوي المكرس تشريعياً، الذي يعترف بالنزاعات التي تدعي فيها الإدارة على الأفراد والتي تعتبر حتما نزاعات عادية للإدارة، فضلاً عن النزاع الإداري.
