يعالج هذا المقال منهجين مهميين في البحث والاجتهاد في علمي الفقه والأصول وكيفية الاستفادة منهما في عملية الارتقاء بعملية البحث العلمي وتكوين الباحث، نقول إنه قد تباينت في هذا المجال مناهج الاجتهاد، بين منهج التقليد والمتمثل في التخريج الفقهي والأصولي، ومنهج التجديد. وهما طريقتين متكاملتين، فلا يمكن لمجدد في الفقه والأصول أن يرقى لهذه الرتبة دون أن يكون مجتهداً متمذهباً محصلا للمذهب فروعه وأصوله قادراً على استنباط الأحكام الشرعية وفق منهجية صاحب المذهب، وإلحاق النوازل الجديدة التي لا نص فيها بالأحكام المنصوصة، وقد دللنا على هذه الفكرة بمراحل الاجتهاد والطلب عند الإمام المجدد أبي إسحاق الشاطبي والذي يعد أحد مجددي أصول الفقه المالكي.
