Overview
يعد الحق في الثقافة من الحقوق المكتسبة التي نص عليها دستور 2016 في المادة 45 منه وهي بذلك تشمل في مجملها التراث المادي والتراث الغير المادي وقد خصها المشرع بحماية خاصة من خلال إصدار مجموعة من القوانين ومنها القانون رقم 98-04 المؤرخ في 15 يونيو سنة 1998 والمتعلق بحماية التراث الثقافي هذا بالإضافة إلى نصوص قانونية أخرى سنحاول دراستها في هذه المداخلة. من خلال تحديد مفهوم للثقافة وموقف المشرع الجزائري من دسترة هذا الحق.
