يعتبر الحق النقابي من الحقوق الأساسية المكرسة في الدساتير الجزائرية، غير أن واقع حرية الممارسة النقابية في الجزائر أصبح محل عديد التساؤلات حول حقيقتها من الناحيتين القانونية والعملية وما يؤكد ذلك الزيارات المتكررة للجنة رفيعة المستوى التابعة لمكتب العمل الدولي بمناسبة الشكاوى المقدمة من قبل تنظيمات نقابية مختلفة، تدعي أن الإدارة ممثلة في الحكومة الجزائرية تخنق أو تعرقل أو تمنع ممارسة الحق في الحرية النقابية ضمن إطاره القانوني الدولي الصحيح.
