Overview
يعد طلب الاستقالة مظهرا من مظاهر الإرادة الحرة للعامل الأجير باعتباره تصرفا قانونيا أحادي الجانب، إلا أنها قد لا يعبر بشكل صحيح عن الإرادة الحقيقية والجادة للعامل في ترك منصب عمله. كما أن الاستقالة كحق مكرس قانونا جاء في صيغة العموم إذ لم يفرق قانون العمل فيه بين العقود المحددة المدة وغير المحددة المدة مما قد يشكل مساسا بحق المستخدم في استمرارية نشاطه، وعليه تظهر أهمية الدراسة في بيان جملة من الضمانات التي أقرها كل من التشريع والقضاء للحفاظ على منصب العمل وهي تعود في أصلها إلى شروط الاستقالة الموضوعية والشكلية، بالإضافة إلى الأسباب المعدمة لأثر الاستقالة.
