Overview
سعى المشرع الجزائري إلى إيجاد نوع من الاستقرار والموازنة بين حقوق العمال ومصالح المستخدمين في عقد العمل المحدد المدة الذي يعد استثنائياً، إذ خول للموثق باعتباره قاضي العقود صلاحية إبرامها وضمان صحتها وفق شروط معينة وفي حالات محددة حصراً بالمادة 12 من القانون 90-11، كما عمل على توفير الحماية القانونية اللازمة لها ورتب على مخالفة أحكامها جزاءات مدنية وأخرى جزائية.
