Overview
تناول هذا البحث التحليل الفقهي للضابط: (ما يستهلك بالانتفاع به مع إمكان استبداله يصح وقفه)، إذ شرح معنى الضابط وبين صيغه، وأوضح أرجحية صحة وقف الأصول المندرجة فيه وأدلة ذلك وأسبابه، كوقف النقود والطعام بشرط الاستبدال. وعرض أهم صور تطبيقات الضابط في التراث الفقهي والواقع المعاصر. وقارن البحث موضوع الضابط مع مواد قانون الوقف الكويتي، إذ كشف عن بعض الثغرات في تلك المواد في ضوء مقتضيات هذا الضابط مقدما بعض الاقتراحات لسد تلك الثغرات في مواد القانون ومذكرته الإيضاحية. ومن زاوية أخرى وضح البحث علاقة مضمون الضابط باقتصاديات الوقف؛ مبينا أبرز الآثار الإيجابية الناتجة عن تطبيقه في الميدان الوقفي.
