Overview
يسعى هذا البحث إلى تحديد الإطار الذي يضبط مبدأ التناسب بين الجريمة والعقوبة، ويحول دون الإخلال به، بصياغة نصوص جنائية تكفل حماية مصالح المجتمع، ولا تنال من حق الجاني في عقوبة تناسب الجرم الذي اقترفه دون مغالاة. ويستمد موضوع البحث أهميته كونه يتناول مبدأ من أبرز مبادئ السياسة الجنائية، ولا مجال للحديث عن تشريع جنائي يحقق المصلحة المبتغاة دون لالتزام بتطبيقه، ومن هنا تجرز أهمية أخرى لموضوع البحث؛ وهي إيجاد ضوابط واضحة ومحددة تضمن تطبيق المبدأ محل البحث.
