Overview
يهدف هذا المقال إلى ضبط التكييف القانوني السليم لكل ممارسة تؤثر أو يمكن أن تؤثر سلبا على قواعد حرية المنافسة عندما تهدف أو يمكن أن تهدف إلى عرقلة المنافسة أو الحد منها أو الإخلال بها في سوق معينة أو في جزء جوهري منه قصد زيادة الفعالية الاقتصادية وتحسين ظروف معيشة المستهلكين، وهذا نتيجة إلى أن الكثير من الباحثين يكيف الممارسات المعنية على غير الوصف الذي أطلقه عليها المشرع من خلال الأمر رقم 03-03 المؤرخ في 19 جويلية 2003 المتعلق بقانون المنافسة المعدل والمتمم لاسيما المادة رقم 14 منه.
