Overview
يهدف البحث إلى توضيح قاعدة الحكم بين الحكمين التي تعتبر من مظاهر الوسطية في مدارك الأحكام؛ إذ تعنى بتوليد الحكم البيني من خلال التوسط بين مقتضى الأدلة المتعارضة، وذلك من خلال تحرير ماهيتها وبيان علاقتها بمصطلحات ذات صلة، ومن ثم ذكر أدلة اعتبارها في تحديد مجال إعمالها، وأخيرا شواهدها في بناء الأحكام البينية، ولمعالجة الموضوع تم المزج بين المنهج الوصفي والتحليلي للتكامل بين المنهجين، ولكفاءتهما في إحكام مكونات المادة العلمية، وقد خلص البحث لنتائج عدة منها: أن قاعدة الحكم بين الحكمين تجسد منهج التوسط في مدارك الأحكام لرعايتها الأصول المتنازعة وعدم إهدارها كليا، ومن أهم التوصيات: الدعوة لاستثمار القاعدة في المستجدات لإعطاء كل فتوى قدر ما تستحقه بحسب رتبتها؛ رعيا لتفاوتها.
