Overview
إن الضمان الاجتماعي حقا من حقوق الإنسان وللعمال خاصة سواء داخل الوطن أو خارجه لذا يجب معرفة الشروط الواجب توافرها في المستفيدين، وتجسيد مبدأ المساواة والآثار القانونية المترتبة عن دلك سواء من حيث الجانب النظري أو العملي. هذا ما يؤدي إلى ضرورة دراسة الحماية القانونية، والضمانات للعمال الأجانب، وأيضا معرفة ما إذا كان العامل الأجنبي لا يتمتع بمنافع الضمان الاجتماعي لبلده الأصلي فهل يستطيع الاستفادة، من تلك المنافع وفق تشريعات الضمان الاجتماعي لبلدان الإقامة؟
