Overview
الإجماع هو المصدر الثالث للتشريع، وهو نوعان قطعي يجزم فيه بعدم المخالف ويتفق عليه جميع المجتهدين، وإجماع ظني لا يجزم معه بانتفاء المخالف وإنما يظن ذلك، فإذا ثبت عند المتتبع له انتفاء المخالف وكثرة الموافق - خاصة في زمننا هذا الذي اتسعت فيه الرؤية وكثرت فيه المطبوعات وسهل مع محركات البحث والمكتبات الإلكترونية الضخمة التناول للمسائل والتثبت منها - فأقل ما يكون معيارا لتحقق الإجماع الظني في نفي الخلاف هو التحقق من انتفاء المخالف وحصول الموافق، ليكون إجماعا ظنيا صحيحا، وقد يقدم على ما عارضه من الأدلة الظنية وترجح به الأقوال ولكن لا يصل إلى درجة الإجماع القطعي.
