Overview
إن انتشار جائحة كورونا وضررها بالسوق، جعلت المشرع يتدخل للوقاية ومواجهة ظاهرة المضاربة غير المشروعة، بعدما أصبحت النصوص قانون العقوبات غير كافية لردع هذه الجريمة ومرتكبيها، بحيث صدر قانون 21/15 المؤرخ في 28/12/2021 المتعلق بمكافحة المضاربة غير المشروعة، فلم يكتفي هذا القانون بالنص على الطرق الوقائية لمجابهة جريمة المضاربة غير المشروعة، بل تطرق إلى التصدي الجزائي لهذه الظاهرة من خلال تجريم الأفعال التي تشكل مضاربة غير مشروعة، والذي أعطاها وصف جناية في بعض الحالات وشدد العقوبة، وأعطى للضبطية القضائية سلطات استثنائية، وسنحاول تحليل تلك النصوص لإعطاء نظرة تقييمية لهذا القانون.
