Overview
يتولى القضاء الفصل في المنازعة الانتخابية، باعتباره الجهة الكفيلة بضمان نزاهة العملية الانتخابية نظرا لما يتمتع به من حياد واستقلالية مضمونة دستوريا، غير أن فاعلية الرقابة القضائية يجب أن تدعم بمبدأ آخر وهو مبدأ التقاضي على درجتين والذي يسمح لأطراف النزاع من إعادة طرح منازعاتهم من جديد، على محكمة أعلى درجة لكي تعيد النظر فيها بكافة عناصرها الواقعية والقانونية للمرة الثانية، بهدف الوصول إلى أحكام وقرارات قضائية عادلة ومنصفة خاصة إذا تعلق الأمر بحقوق وحريات أقرها الدستور كحق الترشح وحق الانتخاب.
