لاحتمالات انغلاق الزواج بحتمية حياتية من مشكلات وظروف توصل الزوجين إلى الفرقة، أطلق الطلاق ليكون الحل الشرعي لما انعقد بالشرع من زواج لم يكتب له الصمود، على الرغم مما أحيط به من وسائل حفظ وحماية شرعية وقانونية. هذا الإطلاق أثار جدلا في أروقة الفقه الإسلامي، لكنه استقر في نصوص حسم بها مشرع الأحوال الشخصية العراقي اختياراته بهذا الشأن، وهو ما كان منه في قانونه (قانون الأحوال الشخصية رقم ١٨٨ لسنة ١٩٥٩ المعدل). ليعالج تلك الإطلاقية بنصوص واضحة الرؤية، غير أنها لم تنج مما بحثناه من عيب أو نقص. ساعين لتدارك ذلك بمجموعة من الحلول نراها تلافي ما قد ذكر في قانوننا للأحوال الشخصية.
