Overview
أن للعقار قيمة وأهمية اقتصادية واجتماعية في المجتمع، لذا فإن المشرع الجزائري ووفقا لما جاء في قانون الإجراءات المدنية والإدارية رقم: 08-09 قد وضع قواعد إجرائية دقيقة، إذ أن الهدف من ذلك عدم التسرع في بيع العقار حتى لا يحرم المدين أو صاحب العقار من ملكية عقاره، وذلك من خلال إعطائه المهلة الكافية لتسديد الدين بدلا من بيع عقاره المحجوز، وتعد القواعد الإجرائية المنظمة للحجز العقاري قواعد آمرة لا يجوز للدائن الحاجز مخالفتها.
