Overview
يعد التعويض عن أعمال الشغب والمظاهرات على أساس المخاطر بمثابة خطوة تقديمية نحو دعم مركز المضرور في سبيل الحصول على تعويض عما لحق به من ضرر، خاصة وأن من المستحيل عليه تعقب المتسبب في الضرر، خاصة مع وجود حالة العنف الجماعي، وبالتالي، فلم يكن هناك بد من تطوير آلية التعويض بما يكفل مزيد من الحماية للمضرور، كما أن التعويض على أساس الخطأ يعني الوصول بالمضرور إلى طريق مسدود، وسوف نتناول هذا البحث من جانبين أساسيين، فهناك الجانب التقليدي، الذي يتمثل في التعويض على أساس المخاطر، ومن جانب آخر، التعويض على أساس المخاطر الاجتماعية، التي تقوم على فكرة اشتراكية المخاطر.
