Overview
This article addresses the issue of climate change through the lens of equity, arguing that its impacts are distributed unevenly across countries and communities. While industrialized nations are responsible for the bulk of greenhouse gas emissions, developing countries-particularly in Africa-bear the heaviest costs in terms of environmental degradation, resource scarcity, and social vulnerability. The study frames climate justice as both an ethical and legal principle aimed at balancing responsibilities, whether between the Global North and South or across present and future generations. It highlights the Paris Agreement's recognition of equity as central to climate action and stresses the importance of empowering local communities to build resilience. The article also elaborates on the concept of intergenerational equity, emphasizing the obligation to safeguard the rights of future generations to a healthy environment. Reference is made to international judicial decisions, including nuclear emissions and maritime delimitation cases, which have reinforced this principle. The authors conclude that climate justice is not a mere slogan but a necessary foundation for effective climate policies, requiring a balance between economic development, environmental protection, and equality across peoples and generations.
