Overview
تتميز الجزاءات الإدارية بالطابع الردعي العقابي، أي أن هدفها العقاب على المخالفة والتقصير في أداء التزام أو واجب، وتتصف بأنها قرارات إدارية فردية، أي أن الإدارة هي مصدرة هذا القرار، فهي كذلك تمثل تطبيقا لقانون عقوبات خاص ألا وهو قانون العقوبات الإداري، وتهدف هذه الدراسة إلى التطرق لخصوصية الضوابط المتخذة لشرعية الجزاءات الإدارية وفقا للتشريع الجزائري كما هو الحال في بعض الأنظمة القانونية الأخرى باعتبار أن الإدارة لها سلطة إصدار الجزاءات الإدارية سواء كانت وظيفية أو تعاقدية.
