Overview
يعد التقادم المسقط، أو ما يعرف بمرور الزمن في الفقه الإسلامي، من المسائل الفقهية التي بحثها من قبل الفقهاء المسلمين في القرن الثاني الهجري، وقد ورد شرح وتفصيل لموضوع التقادم في مجلة الأحكام العدلية، بشكل مواد قانونية مرتبة ومتسلسلة مستمدة من الفقه الإسلامي على المذهب الحنفي، وقد أخذت المجلة بمفهوم التقادم المسقط في الدعاوى الحقوقية دون التقادم المكسب للحقوق، وذلك لاعتبارات شرعية فالحق لا يموت؛ ولكن الدعوى لا تسمع قضاء بعد مرور مدة من الزمن ضمن ضوابط وشروط، ولأن للتقادم المسقط أصلد فقهياً فقد ميزت المجلة بين نوعين للتقادم، أحدهما اجتهادي، والأخر بأمر من السلطان، ورتبت أحكاماً خاصة لكل منهما.
