Overview
Ijtihad maslahi, a term that has become necessary due to the nature of scholarly research, can be defined as striving to select the preponderant opinion and avoid the weak in both religious and worldly matters using evidences from the primary texts of Islam, the actions of the Prophet's companions and scholarly opinions. Ijtihad, according to al-Shatibi, must embrace moderation, meaning it must strictly adhere to the constants of religion without negligence so as to give expression to the provisions of the Shari'ah in general and ijtihad on the basis of public interest in particular.
