يكتسي العقار، منذ القدم، أهمية بالغة بالنسبة للإنسان وذلك بسبب قيمته الاقتصادية وحتى الاجتماعية، لذلك سعى هذا الأخير إلى حوزه واكتسابه. وبالتالي، فإن الغاية من هذا البحث هو التركيز على دراسة الكيفية التي يؤدي الحوز فيها إلى اكتساب ملكية العقار وذلك في القانون التونسي؛ أي بعبارة أخرى، فإن الهدف من هذه الدراسة هو التطرق إلى أركان الحوز وصفاته وأجاله التي من شأنها أن تكسب ملكية العقار وذلك بالطبع، مع التأكيد على أن أملاك الدولة العامة والعقارات المسجلة لا يمكن أن يقع حيازتها.
