Overview
يهدف البحث إلى بيان معنى توثيق الطلاق وأثره في المحافظة على الحقوق، وأن الحاجة داعية لتوثيقه بالسجلات الرسمية، حيث إنها أقوى الوسائل لإثبات الطلاق عند الإنكار، وقد اقتضى العصر توثيق الطلاق لخطورته وفساد الذمم، والعوارض كالنسيان والرجوع عن الشهادة مما يؤدي إلى منع إيصال الحقوق لمستحقيها، هذا وقد اتبعت في البحث المنهج الاستقرائي التحليلي المقارن، ومن أهم نتائجه أن التوثيق يقوي العقد ويصونه من التلاعب، وهو معلل بمصلحة حفظ الحقوق وضمانها، ومنها أن الطلاق الشفهي واقع ومحتسب من عدد الطلقات التي يملكها الزوج، كما قرر القانون وقوع الطلاق بمجرد النطق به، فعلى المطلق إذا أوقع طلاقا أن يسرع بتوثيقه رسميا لدى الدوائر والهيئات الحكومية.
