Overview
إن الشريعة الإسلامية تمتلك أسباب الخلود والبقاء لصلاحيتها ومرونتها واستيعابها لجميع المكلفين على اختلاف أحوالهم وظروفهم، والعرف كان وما يزال وسيظل بابا واسعا لنمو التشريع وتطوره؛ لأنه يتفق مع ملابسات الناس ومقتضيات الزمان، وملاحقة التطور البشري، يمد الفقهاء والمفتين بأحكام مناسبة لعصرهم ويرشدهم إلى مقاصد الناس في تصرفاتهم، وحقيقة العرف والعادة واحدة، وإن اختلفا في الاصطلاح والخلاف بينهما لفظي لا يترتب عليه أثر، والعرف عند الشارع له مكانة وأهمية قوية وعميقة، وأثر في القدرة على استنباط الأحكام الشرعية بعد الرجوع إليه، والعرف إما أن يكون موافقا لما جاء الشرع به واعتبره في الاستدلال به، فهذا يجب الأخذ به، وإن كان مخالفا له فهذا يجب رده وعدم الأخذ به.
