يعد تعديل الحق في الكراء ضمانة أساسية لبقاء الأصل التجاري المتألف إلزاما من الزبناء القارين والعارضين الذين لا تمكن المحافظة عليهم إلافي ظل تجديد حق الكراء وتعديله إذا تطلب الأمر ذلك وفق الضوابط والشروط المختلفة تبعا لاختلاف أنماط التعديل. وبهذا التعديل نكون أمام قيمة كرائية عادلة مصدرها الاتفاق أو القضاء، تعطي توازنا حقيقيا بين الملكية التجارية والملكية العقارية، ويترتب على تلك القيمة العادلة بقاء واستمرار الأصل التجاري باعتباره مؤسسة تجارية كانت ولا تزال محور الأنشطة الاقتصادية من إنتاج وتوزيع وخدمات. وهوما يجعل من بقاء واستمرار الأصل التجاري هدفا يسعى إليه المشرع الموريتاني كغيره من التشريعات الأخرى، وما ذلك إلا لما ينجر عن حماية الأصل التجاري من المزايا العامة والخاصة.
