عنيت الدراسة الراهنة بدراسة التشريع الاجتماعي متمثلا في قانون الأحوال الشخصية، وأثر ذلك القانون على قضايا الأحوال الشخصية، أو ما تعرف مجتمعيا باسم قضايا الأسرة، فالمجتمع المصري يمر حاليا بحالة جدلية من الحوار المجتمعي حول قانون الأحوال الشخصية ما بين مؤيد ومعارض لتغيير القانون، وبين مؤيد ومعارض للآلية التي يتم وضع قانون جديد من خلالها، وكذلك هناك خلاف وحالة من الجدل حول الحقوق التي يكفلها القانون لكلا الزوجين والأبناء، مما دفعنا إلى البحث من خلال هذه الدراسة حول الإشكالية المثارة حول قانون الأحوال الشخصية.
