إن تشكيل المجالس الجماعية يرتكز على مقتضيات القانون التنظيمي المتعلق بانتخاب أعضاء مجلس الجماعات الترابية والذي يميز فيها تشكيل المجلس الجماعي بين الجماعات الغير مقسمة إلى مقاطعات وبين الجماعات المقسمة إلى مقاطعات كما تم تطرق إلى اختصاصات هاته المجالس كذاتية ومنقولة.
