Overview
تدور الدراسة حول الإثبات التجاري من خلال مبدأ حرية الإثبات الذي أكدته التشريعات وأعطى الخصوصية للقانون التجاري في انسجام مع خاصيتي السرعة والائتمان وتعزيز الثقة بين التجار، وقد تعرضت للاستثناءات الواردة على المبدأ خصوصا الشكلية المطلوبة في عقد الشركة، والتصرفات الواردة على الأصل التجاري، والذين اشترط فيهما القانون الكتابة وعبر صراحة عن الخروج عن مبدأ الحرية في الإثبات حرصا على المصالح ومراعاة لخطورة التصرفات الواردة على هذه العقود، كما تعرضت لدفاتر التجار والفوترة الذين يمثلان خصوصية في الإثبات التجاري وخرقا لأهم مبادئ الإثبات.
