Overview
من أهم مميزات الفقه الإسلامي المصطلحات الشرعية التي يختص بها كل مذهب، ومن تلك المصطلحات التي تبين مقصود الفقيه أو الأصولي لقوله أو حكمه لفرع من الفروع الفقهية مصطلح (ووجه ذلك)، أو ما يصطلح عليه توجيهات الفقهاء الأقوال أئمتهم أو أقوال المتقدمين عنهم، مما يندرج تحت التأصيل الفقهي للفروع أو تخريج الفروع على الأصول في باب من أبواب الفقه، كما اشتهر المذهب المالكي العمل بها، ومن أمثالهم الفقيه ابن يونس الصقلي الذي وجه أقوال تلاميذ الإمام مالك التي كانت مبثوثة في كتب الفقه، وذلك في كتابه الجامع لمسائل المدونة والمختلطة، في العبادات المعاملات.
