تعتبر الإساءة الدينية في سياق حق حرية التعبير قضية جدلية لها خلفية قانونية وفلسفية والصفة المثيرة فيها أكثر للجدل أنها عاطفية وإيديولوجية لم تقتصر على مواقف الأفكار والعقائد والفلسفات فحسب، بل صارت شكلا من أشكال الدفاع المقدس عن القيم الديمقراطية لدى معظم مفكري الليبرالية السياسية تهدف هذه الدراسة إلى تجريد هذه القضية الجدلية من جانبها العاطفي والأيديولوجي والوصول بها إلى نهاية الوضوح والإقناع العلمي من خلال استعراض وجهات نظر نقدية مختلفة حول ما جاد به الفكر الدولي من مناقشات وتحليلات قانونية حولها.
