Overview
هدفت هذه الدراسة إلى التعرف على أهداف وآليات التدخل القضائي في تطبيق تشريع المنافسة، كما خلصت إلى أن تدخل القضاء في تسوية منازعات المنافسة يرمي من جهة إلى حماية المنافسة الشريفة داخل السوق وضمان انسيابية قوانين هذا الأخير، ومن جهة أخرى إلى حماية الفاعلين الاقتصاديين من شطط مجلس المنافسة والتعويض عن الأضرار الناجمة عن الممارسات المحظورة، وكل هذا يتم عبر عدة آليات منها ما هو مباشر كتسوية المنازعات المدنية أو الجنائية للمنافسة، ومنها ما هو غير مباشر كممارسة الرقابة القضائية على قرارات مجلس المنافسة بواسطة كل من القضاء العادي والقضاء الإداري.
