Overview
يرمي القضاء الاجتماعي من خلال أحكامه وقراراته إلى بسط رقابته على قرارات المشغل تجاه إجراءه، والسهر على استمرار تنفيذ عقود العمل، بشكل يوفر الحماية للأجير باعتباره الطرف الضعيف في العلاقة، وفي نفس الوقت تجنيب المشغل هدر الوقت والمال في نزاعات قد يمتد صداها لا محالة إلى مقاولته، وبالتالي فإن هذا المقال يروم دراسة مدى الحماية التي وفرها القضاء المغربي للأجير، من خلال تنزيله لمقتضيات مدونة الشغل أرض الواقع في أحكامه وقرارته، خصوصا في بعض القضايا التي سكت عنها المشرع، وفي دوره أيضا في إحقاق التوازن العقدي بين المشغل باعتباره الطرف القوي، والأجير باعتباره الطرف الضعيف.
