ومقالانا هذا عبارة عن تأملات نابعة من احتكاكنا بالواقع العملي، لأنه لا واقع عملي بدون تنظير أو تأمل، وعليه فالمشرع المغربي من خلال القانون رقم 95.17 قسمه لقسمين أساسيين، تناول في القسم الأول منه للتحكيم والقسم الثاني خصصه للوساطة الاتفاقية، وقد نظم ضمن القسم الأول كل من التحكيم الداخلي والتحكيم الدولي، ومقالتنا هاته سنخصصها لمدارسة الباب الأول المتعلق بالتحكيم الداخلي، وخاصة قواعد ما قبل صدور الحكم التحكيمي.
