Overview
تشكل أراضي الجموع (السلالية) داخل المنظومة العقارية المغربية رصيدا وطنيا مهما، الشيء الذي يجعلها في صلب التنمية الاقتصادية والاجتماعية، وهو ما حذا بالمشرع لتنظيمها بمقتضيات قانونية منذ عدة عصور، غير أن التطورات الحاصلة على عدة مستويات أبانت قصور هذه النصوص التنظيمية، الشيء الذي دفع المشرع إلى سن وتعديل قوانين جديدة تستوعب الإشكالات التي يفرزها الواقع العملي، سواء فيما يخص الشق المدني أو الجنائي، لكننا سنتخصص في هذه المقالة في الشق الأخير، لنسلط الضوء على المستجدات التشريعية الجديدة ومدى نجاعتها وقدرتها على حل الإشكالات التي تعتري هذا الوعاء العقاري.
