Overview
الجنسية موضوع ودقيق عني به المشرع والفقه في الدول كلها، إذ درس إثباته ومبادئه وقواعده، وأن الجنسية رابطة قانونية سياسية تربط بين الشخص ودولته، وتجعله أحد أفراد شعبها فهي ركن الشعب في الدولة. لذا تعد مسألة إثبات الجنسية من المسائل المهمة لكونها تحدد انتماء الشخص لدولة أو عدم انتمائه لها، واكتساب الحقوق والتحمل بالمسؤوليات، فمن باب الحقوق يكون له الحق في التمتع بجميع المزايا التي تمنحها له الجنسية، وهو حق الترشيح للمناصب السيادية في حالة كون الجنسية أصلية، وحق الانتخاب الذي يشمل أيضا الحاصلين عليه بطريق الاكتساب، وقد تناولنا هذا الموضوع لوجود إشكاليات كثيرة في الإثبات، والتي لم يتناولها المشرع العراقي.
