Overview
يعد حق الملكية من أبرز وأهم الحقوق الدستورية والقانونية، نظرا لما يمثله من أهمية في حياة الأفراد والدولة، ودوره الحيوي في شتى مناحي الحياة الاقتصادية والاجتماعية والتنموية، فقد تحدث البحث عن تعريف نظام الملكية الخاصة من أجل المنفعة العامة القائم على المساس بحق الملكية الفردية التي كفلتها الدساتير، وقد يختلط مفهوم هذا النظام مع أنظمة أخرى كالاستيلاء المؤقت، والمصادرة، لما تحتوي من اعتداء على حق الملكية، إلا أنها تختلف عنه من حيث المحل، والغاية والإجراءات.
