Overview
يعد مبدأ المشاركة في الأرباح والخسائر من الأركان الموضوعية الخاصة بعقد الشركة، التي يتميز من خلالها عقد الشركة عن غيره من العقود، وبما يتوافق مع مبدأ نية المشاركة، الذي يجمع الشركاء لغرض تأسيس هذا المشروع وتحقيق الربح الذي ينعكس بصورة إيجابية على جميع الشركاء من خلال الاتفاق على آلية معينة لتقسيم ما تنتجه الشركة من الأرباح وتحمل الخسائر، بعد استيفاء المصروفات التي أوجبها القانون على الشركة، إلا أن قانون الشركات العراقي أجاز استثناء الإعفاء من الخسائر مع التمتع بالأرباح للشريك في الشركة البسيطة مقابل تقديم حصة من العمل وفق ضوابط وشروط محددة يتميز بها هذا العمل.
