Overview
قبل الدخول في جوهر إشكالية البحث والتي تتعلق بالإجراءات الدولية التي تهيمن على تنفيذ أحكام التحكيم الدولية المتولدة من عقود إدارية ذات طابع دولي، فإن الباحث يرى أنه من الضروري أن يستعرض مسألة إجرائية دقيقة لها صلة وثيقة بهذا الموضوع ألا وهي تمسك الدولة بالحصانة القضائية في مواجهة تنفيذ حكم التحكيم الصادر ضدها. ولا شك أن الدفع بالحصانة القضائية يعد في الحقيقة دفعا إجرائيا يدخل تحت طائفة الدفوع الشكلية التي لا تتعلق بموضوع النزاع وتهدف إلى منع تنفيذ الحكم دون التطرق إلى مدى صحة الحكم من عدمه.
