Overview
أدت التطورات التي عرفها العالم بفضل التطور التكنولوجي والعلمي إلى تزايد الأضرار الناتجة عن تهديد المحيط البيئي، التي تتمثل أساسا في الاحتباس الحراري والتغيرات المناخية، وتدهور الغطاء النباتي ونفوق الأسماك والكائنات الحية، وارتفاع نسبة التلوث في مياه الأنهار والبحار والمحيطات...، وكان نتيجة لذلك أن ترتب عن هذه الأضرار إنشاء تشريعات لمساءلة المخالفين للالتزامات والواجبات المتعلقة بحماية البيئة، وهو ما يسمى بالمسؤولية المدنية عن الأضرار البيئية، هاته الأخيرة تختلف عن غيرها من الأضرار العادية سواء على مستوى خصائصها، أو على مستوى الأساس الذي تقوم عليه، أو في ما يخص التعويض عنها.
