تبحث هذه الدراسة في الأحكام الشرعية المتعلقة باستبدال الوقف، وتهدف إلى جمع أقوال المذاهب الأربعة بشأن هذه المسألة، مع بيان مواضع الاتفاق والخلاف، ثم تحليل الأدلة الشرعية ذات الصلة بغية الوصول إلى نتائج تدعم اتخاذ قرارات مناسبة تتماشى مع المستجدات المعاصرة. اعتمد البحث على منهجية وصفية واستقرائية تحليلية تناولت تعريف المصطلحات، وجمع أقوال العلماء، ومناقشة مدى تناسقها مع واقع الأوقاف في العصر الحالي، وخلصت الدراسة إلى جواز استبدال الوقف إذا خرب فهو لم يعد ينتفع به وزال منه مقصود الوقف، بل لا بد حتى يتم الحفاظ على أهم مقصد فيه إصلاحه وتبديله عند الحاجة.
