Overview
يعد تعزيز الأفضلية الوطنية أحد آليات نظام الصفقات العمومية بالمغرب منذ عقود. وتشكل المادة 147 من مرسوم الصفقات العمومية الجديد تكريسا لتوجه الدولة نحو الأخذ بهذه الآلية، وإضفاء الطابع الإلزامي عليها، باعتبارها آلية لدعم وتعزيز ولوج المقاولات المغربية للصفقات العمومية. إلا أن القراءة التحليلية والنقدية الأولية لسياق ومضمون المادة 147، تبرز عددا من الحدود الذاتية والموضوعية التي يمكن أن تواجه تطبيقها، وتحول دون بلوغها لجميع أهدافها. خصوصا وأن هذه الآلية كانت موجودة منذ عقود، لكنها لم تحقق ما كان مرجوا منها.
