يركز الجزء الثاني من هذا البحث على موقف التشريع الجنائي المصري من مكافحة الفساد، حيث يتناول بالتحليل دور قانوني العقوبات والكسب غير المشروع في الحد من جرائم الفساد الإداري والمالي، وبحث مدى كفاية النصوص التشريعية القائمة لمواجهة تلك الظاهرة لما لها من آثار سلبية على الدول وعلى الأفراد، وبحث دور القواعد الإجرائية في مواجهة الفساد ومنها التصالح في جرائم العدوان على المال العام وأثره في الحد من جرائم الفساد.
