Overview
يتناول البحث كيفية معالجة القضايا المعاصرة وفقاً لقانون الشرع الذي بين الله قواعده في شريعته، ورسم أساسه بأدلته، وفهمه علماء الأمة عبر القرون، فاعتبروه في اجتهاداتهم وفتاواهم، ويتلخص هذا القانون في ضرورة اعتبار النص والواقع والمآل وحال المكلف عند النظر في القضايا المتعلقة بالمكلفين؛ لأجل تحقيق مقاصد الشرع من تكليفهم وتتلخص تلك المقاصد في جلب المنافع ودفع المضار في الحال والمآل واحتاج الباحث لذلك مناهج الاستقراء والوصف والمقارنة، وخلص إلى نتائج أهمها: أن الاجتهاد المعاصر له ركائز ثلاثة هي النص والواقع والمآل، وأن سد الذريعة وسيلة لتحقيق مقاصد الشريعة بمعرفة المآل، وأن قانون الموازنة بين المنافع والمضار هو الضامن لاستمرار احتواء الشريعة لكل جديد.
